Abstract

Проаналізовано положення кримінального процесуального права Німеччини щодо провадження стосовно відсутніх осіб як альтернативи провадженню in absentia. (The genesis of proceeding by default in the criminal justice of Germany which originates from Ancient Rome, its imperial period, is demonstrated in the article. The tendency of a negative attitude of German criminal procedural law to proceeding in absentia is shown. The effective criminal procedural law of Germany knows two types of criminal proceeding by default. The first type, which has seven kinds, refers to minor offences, the punishment for which does not provide for the loss of liberty and where the defendant does not evade justice. The second type refers to all criminal indictable offences, including felony and treason, and is applied to the individuals who evade investigation and justice, and whose location is unknown. Such type of proceeding is called ‘proceeding concerning absentees’. Its tasks are to provide evidence and encourage an absent defendant to appear in court by temporary seizure of his/her property, and to apply such incentive as a guarantee of immunity, mainly by ensuring that preliminary imprisonment will not be applied to an absentee as a preventive measure. During such proceeding a charge (case) is not being heard on the merits. The question of guilt or innocence of an absent defendant is not raised, so the infringement of procedural rights vested on the defendant during the main court hearing is excluded. The proceeding concerning absentees according to the Criminal Procedural Code of Germany is an alternative to proceeding by default (in absentia) in that way as it is applied in some states of the world, including Ukraine. Such proceeding showed itself from the positive side as an effective legal mechanism of ensuring that an absent defendant will appear in court. So we should borrow the experience of Germany in this matter.)
